Apex Park and Recreation District Privacy Policy, Release and Waiver, Refund and Cancellation Policy, Patron and Comment Code of Conduct, and Website Accessibility Policy.
We will under no circumstances sell, lease or otherwise disclose any of your personal or contact details to any individual or organization not connected with Apex Park and Recreation District unless we have first obtained your written permission to do so.
Signing this release has legal consequences. By signing this release, the participant, on behalf of themselves and/or their minor children, are giving up rights they may otherwise have. You certify that you have read and understand this release.
I, as the participant or the parent/guardian of a minor child participant, hereby grant permission for myself or my minor child to participate in the programs, events, facilities, and related activities (collectively, "programs") provided by the Apex Park and Recreation District ("district"), including any reasonable accommodations that may be necessary. I agree to abide, or to require my minor child to abide, by the district's rules, policies, and procedures during the period of my/their participation.
I understand and agree that participation in the district's programs involves inherent risks, hazards, and dangerous activities that may result in severe permanent injury or death, and/or emotional injury or trauma. Such inherent risks, hazards, and dangerous activities may be either known or unanticipated, and may include, but are not limited to:
- Accidents related to the program activities, which may result in injuries to the bones, joints, or ligaments; head or neck injuries; injuries to the skin, tissues, or organs; and/or injuries to the mouth, teeth, or lips;
- Accidents involving vehicles, equipment, supplies, tools, or chemical hazards, including, but not limited to chemicals commonly used for cleaning and/or aquatics operations;
- Accidents involving submersion or drowning in the district's pools or other ponds, lakes, streams, or other standing water located on or around the district's or district-operated facilities;
- Exposure to communicable diseases which may cause severe illness and/or death even in individuals having no known risk factors or preexisting conditions, including but not limited to, exposure to the COVID-19 virus and any variants thereof;
- Structural or maintenance defects of any kind to the program room or district or district-operated facilities;
- Slipping, tripping, or falling;
- Contact with moving, falling, flying, or stationary objects, or with other individuals, including but not limited to other participants, instructors, district employees/volunteers, or members of the public;
- With respect to outdoor activities, severe or changing weather conditions, contact with irregular or hazardous conditions of natural elements, and contact with domestic or wild animals or insects;
- Conditions associated with participation in strenuous activity, such as shortness of breath, labored breathing, fatigue, headache, nausea, muscle soreness, or cramps;
- Emotional injury or trauma resulting from or relating to any of the foregoing.
Having read and understood the above, I expressly understand and agree, for myself or on behalf of my minor child, that participation in the programs involves inherent risks, hazards, and dangerous activities that may result in severe permanent injury or death, and/or emotional injury or trauma, and that I am responsible for and hereby voluntarily assume any and all risks associated with my participation or my minor child's participation in the programs. I certify that I am, or my minor child is, physically fit to participate in the programs and I am not aware of any physical or mental condition that could result in injury or death, or that could be exacerbated or worsened, as a result of my or my minor child's participation in the programs.
I wish to enroll myself or my minor child in the programs notwithstanding the known or unanticipated risks, hazards, and dangerous activities inherent in my/their participation. In consideration for being permitted to enroll in the programs, I hereby release, waive, and discharge the district and its current and former directors, officers, employees, volunteers, agents, and representatives from any and all liability, causes of action under any theory of law or equity, claims and demands, damages, costs, expenses, and compensation arising from or relating to any injury or damages, including death, incurred by me or my minor child as a result of participating in the programs.
I further agree to indemnify, defend, and hold harmless the district and its current and former directors, officers, employees, volunteers, agents, and representatives (collectively, "Indemnitees") from and against any loss, liability, damage, claim, cost, or expense of any kind or nature whatsoever (collectively, "claim"), which one or more of the Indemnitees may incur due to my or my minor child's participation in the programs. The Indemnitees shall have the sole right to select legal counsel to defend them in connection with any claim, notwithstanding my obligation to pay the fees, costs, and expenses incurred by such legal counsel.
Nothing in this release is intended and shall not be construed as a waiver of the limitations on damages or any of the privileges, immunities, or defenses provided to, or enjoyed by the district and its current and former directors, officers, employees, volunteers, agents, and representatives under common law or pursuant to statute, including but not limited to the Colorado Governmental Immunity Act, C.R.S. § 24-10-101, et seq.
In the event I or my minor child is injured or becomes ill, I hereby authorize the district personnel in charge to seek and consent to any first aid or medical treatment necessary to stabilize or treat me or my child.
I further acknowledge that photographs or videos may be taken by designated district personnel during the course of program activities. I agree that in the event I or my minor child is photographed or videoed while participating in the program activities, such photos or videos may be used by the district for legitimate purposes, including advertising, marketing, operational reporting to the board of directors, historic archiving, and posting on the district's social media accounts.
- Refund requested 5 business days or more before the activity: Fee paid minus $5 service charge.
- Refund requested less than 5 business days before the activity: Fee paid minus $5 service charge, plus any cost incurred (if minimum class size is met).
- Refund requested after activity starts: No refund.
- Cancellations: Activity canceled by Apex PRD: 100% refund.
Appropriate and civil conduct is required of all patrons while at the district's facilities, parks, and pools and while participating in the district's programs in order to promote a safe and enjoyable experience for all. "Patrons" include all participants, parents, chaperones, spectators, and guests present at a district facility, park, pool, or program. The rights of certain individuals are protected by the Americans with Disabilities Act, and appropriate accommodations will be made for those individuals.
Expected behavior includes, but is not limited to:
- Treating all patrons and district staff with respect and courtesy. Harassing, abusive, or threatening conduct or language directed at any person will not be tolerated.
- Complying with all rules of the district facility, park, pool, or program.
- Complying with the requests and directions of district staff.
Unacceptable behavior includes, but is not limited to:
- Disruptive or unsafe behaviors, including any conduct that interferes with the use or enjoyment of district facilities, parks, pools, or programs by other patrons or that interferes with the ability of district staff to perform their duties.
- Lewd or indecent conduct, or obscene language or gestures.
- Activities or behaviors that result in damage to any district property or the property of other patrons.
- Any unlawful activity.
Any patron who violates this code of conduct or is otherwise acting inappropriately or disrespectfully may be asked to leave the facility, park, pool, or program or may be withdrawn from the remaining duration of a program. Extreme or repeated violations, or any violation that threatens the health or safety of another person, may result in revocation of the privilege of using the district's facilities, parks, pools, and/or programs for such duration as district staff determines is appropriate given the circumstances of the conduct or incident, which may include an indefinite revocation of privileges. Any person subject to a revocation may submit a written request for review and modification to the executive director, who shall consider the request and render a final determination after exercising their discretion.
